If you read the caption carefully, and by itself, it doesn't really imply she is nude. But putting her on the cover WOULD give people that impression. Where they can really be in trouble though is using the pic commercially if they don't have a release.. The sexy pics listed below your article don't really matter. I've seen models who will wear sheer lingerie to a shoot and not feel nude, but won't do nudes for any price or reason. It may seem silly, but its their right to draw their line in the sand and stick by it. She is a celebrity, and a great deal of this country is still conservative, and still considers Playboy porn. So she has a pretty good argument going for her..
